I understand your thinking Chris, but please don't put yourself
through such a battle for our benefit.
1. I'm not sure it would be of that much benefit.
2. Taking legal risks with the shelter that protects your family
from the rain, wind, snow, ice, heat, cold, and sun is simply not a
sensible risk.
3. You would also be taking significant monetary risks. The legal
fees and fines if you choose to do battle could be significant. The
amount involved would depend upon what happens, how you approach it,
and how far it goes.
4. Making enemies with your LOCAL authorities is a step that may
cause you headaches for years, perhaps as long as you continue to
live in your house.
5. Your issue is A LOCAL ISSUE. Your fight won't affect the IBC
code. At best the lessons learned will be about how your local
authorities react and apply the written codes. It won't give us any
information about how to propose a code to the IBC. Probably IBC
officials will never hear about your case. If they do, those IBC
officials will only hear the negative points from your local
officials. The locals will be only seeking guidance about how to use
the existing codes and the legal system to drop the hammer on you.
This is NOT how we want to introduce ourselves to the IBC. Each
local community or county decides on its own whether or not they want
to adopt the IBC code. Once they do. It's up to each local
community to choose how to enforce it.
6. We all need to gain allies, not enemies.
I could continue this list of points detailing why picking such a
fight with your local building inspectors is a bad idea, but I think
my point is made. The choice, of course, is up to you.
